Accused murderer Oral "Nick" Hillary will be released from jail

(WTNY) - Accused murderer Oral "Nick" Hillary will soon be released from jail. Hillary was indicted by a grand jury in May on a
charge of second degree murder and was quickly taken into custody.

Hillary is alleged to have killed 12 year old Garrett Phillips at an apartment in Potsdam back in October 2011.

Hillary has been in jail since that time as both prosecutors and his attorneys have argued over his release on bond. In a ruling issued Thursday, Judge Jerry Richards says Hillary can be released on $150,000 bond. But, there are conditions. Those include Hillary surrendering his passport and he must ask the court for permission to leave St. Lawrence County unless it is to meet with his attorneys.

The release is not immediate. The terms have to be finalized through an appearance in court by the defendant, which could happen next week.
