Day one of the Oral “Nick” Hillary trial is in the books.
Attorneys for both sides spent about two hours in court Tuesday, with prosecutors pushing for the judge to reverse his decision to not allow certain DNA evidence into the trial–evidence that supposedly clears another suspect while incriminating Hillary.
The judge says he will consider the argument and make a ruling today or tomorrow.
The defense, meanwhile, focused in on an Online anti-Hillary petition, wanting everyone’s name who signed it in order to prevent them from being on the jury.
Selection of the jury, which will consist of 12 jurors and four alternates, should start as early as today.
Hillary is facing a second-degree murder charge in the death of 12-year-old Garrett Phillips.
