There will not be another trial for the Deer River woman convicted in the overdose death of a Carthage teen. A judge denied Brenda Roth’s request, and instead sentenced her to four to 12 years in prison.
Roth was originally found guilty of, among other charges, second-degree manslaughter and criminally negligent homicide in connection with 15-year-old Derek Holton’s death.
Holton died in Roth’s home in 2015 after overdosing on drugs she gave him.
Roth’s attorney had petitioned the judge to throw out the convictions, arguing that his client couldn’t be guilty of both manslaughter and homicide in the same death.
While denying a retrial, the judge did dismiss the charge of criminally negligent homicide.
