Oral “Nick” Hilary seeking to push back trial date

With just under two months before his scheduled trial, Oral “Nick” Hillary has hired new attorneys for his defense and it could mean a delay to the start of the trial until 2016.

Hillary has hired Gary Miles and co-council John Collins for his legal defense. The two replace Edward Narrow, who had been Hillary’s council for most of the legal proceedings against him.

The forty one year old is facing a charge of second degree murder for allegedly strangling 12 year old Garrett Phillips in the boy’s home in Potsdam back in October 2011.

The change in attorneys came following a legal conference Tuesday morning that also included the DA and Judge Jerome Richards. No reason for the change in attorneys has been given.

Miles is now asking for a delay to the start of the trial so he can get up to date in the case.

St. Lawrence County DA Mary Rain is calling the change in attorneys a delay tactic.

Hillary has maintained his innocence in the case.
