The man accused of killing 12 year old Garrett Phillips in Potsdam nearly four years ago was arrested Monday night, accused of violating a court order of protection involving the mother of the victim.
Forty year old Oral “Nick” Hillary turned himself into police, who charged him with second degree criminal contempt.
He pleaded not guilty during his arraignment and was freed after posting $2500 cash bail.
The alleged violation occurred last Friday when Hillary allegedly made eye contact with Phillips’ mother while Hillary was using the dive-thru at the Seacomm Federal Credit Union branch in Potsdam. Phillips’ mother works at that same bank.
Hillary has maintained his innocence in the murder case and has pleaded not guilty to a charge of second degree murder.
The 12 year old boy was found strangled in his Potsdam home back in October 2011.
Hillary is scheduled to go on trial in November.
