Tony Stewart’s insurance company does not have to defend him

A federal judge has ruled that Tony Stewart’s insurance company does not have to defend him in a lawsuit filed by the family of a Port Leyden native.

The judge said that Stewart’s insurance only covered specific races, not necessarily the one where the NASCAR star was driving in when he hit and killed 20-year-old Kevin Ward Jr.

The incident happened when Ward got out of his race car and was struck by Stewart’s car on the track in Canandaigua back in 2014.

Stewart was cleared of criminal charges by a grand jury but Ward’s family has taken to civil court to prove his accountability in the accident.
