Watertown towing company issued a cease and desist

A Watertown towing company has been issued a cease and desist order by the New York State Attorney General’s office over what the state is calling the illegal towing of vehicles from a downtown lot. The company, Upstate Towing and Recovery, has been accused of towing vehicles from lots located at the Top of the Square Plaza along both Arsenal and Court Streets. Previous owners of the plaza had vehicles towed where the motorists parked but did not visit any of the businesses in the plaza. However current plaza owner Brian Murray, doesn’t have a contract with Upstate Towing and did not authorize the action. Several vehicles were towed from the plaza recently, including one which was reportedly damaged in the process. The AG’s office says it is against state law to tow vehicles from or disabling vehicles in a private parking facility unless the owner or operator prominently displays a conspicuous notice stating the name, address and telephone number of the operator of the parking facility, along with the name, address and phone number of the authorized towing company for the lot. The notice is also required to state that unauthorized vehicles will be towed at the vehicle owner’s expense.
